KENT COUNTY CIRCUT COURT GRANTS COMPLETE DISMISSAL OF LAND USE LAWSUIT

In this case, the plaintiff was a part owner in a mixed-use PUD. Byron Township approved a modification to the PUD without providing the plaintiff notice. The plaintiff claimed a lack of procedural due process, and a “takings” claim. In granting the Township’s motion for summary disposition, the court applied recently adopted changes to the zoning ordinance which included sunset provisions for a PUD. The changes to the zoning ordinance rendered the plaintiff’s claim moot. Byron Township was represented by McGraw Morris P.C. attorney Craig R. Noland.
