KENT COUNTY CIRCUT COURT GRANTS COMPLETE DISMISSAL OF SEWER CLAIM ON BASIS OF GOVERNMENTAL IMMUNITY

This case arose when, during a construction project, the general contractor broke a sewer pipe which caused potential environmental problems on the Rouge River.  The contractor sought restitution under a theory of unjust enrichment. The Court granted our motion for summary disposition, concluding that the unjust enrichment claim was subject to governmental immunity. The North Kent Sewer Authority was represented by McGraw Morris P.C. attorney Craig R. Noland.
